The Indian Youth Congress (IYC) Legal Cell vehemently opposes specific provisions within the proposed Advocates (Amendment) Bill, 2025. While the bill claims to modernize the legal profession, certain clauses pose significant threats to the autonomy, rights, and integrity of legal practitioners across India.

“The Advocates (Amendment) Bill, 2025, is yet another attack on democracy by the BJP-led government, aimed at silencing the legal fraternity and eroding the independence of the judiciary. This bill seeks to weaken their ability to raise their voices against systemic issues and government overreach. The Indian Youth Congress stands firmly with the legal community in opposing this draconian legislation. You may attempt to silence our voices—the voices of the voiceless— but you can never suppress our thoughts, ideologies, or vision. Erosion of the Right to Protest (Section 35A), the bill introduces Section 35A, categorizing any form of strike or court boycott by advocates and Bar Associations as professional misconduct. This blanket ban disregards the historical significance of peaceful protests in advocating for judicial reforms and addressing systemic issues within the legal framework.

By restricting the ability of legal professionals to organize and express dissent, the bill undermines the fundamental rights enshrined in the Constitution, particularly the freedom of speech, expression, and assembly.

Increased Governmental Influence over the Bar Council of India (BCI)
The amendment permits the Central Government to nominate up to three members to the BCI, potentially compromising its independence. This shift from a self-regulatory body to one with governmental appointees raises concerns about impartiality and the potential for political interference in professional matters. This attempt to capture the Bar Council of India is part of the BJP’s consistent pattern of undermining independent institutions, as evident in recent examples like the Election Commission of India and the Central Information Commission, where appointments are now subject to government approval.

Furthermore, the bill grants sweeping powers to the Central Government to issue directives to the BCI, encroaching upon the autonomy of the legal profession and increasing the risk of conflicts of interest.

Stringent Disciplinary Measures and Verification Processes

The bill proposes severe penalties, including suspension or disbarment, for actions deemed professional misconduct. However, the broad and ambiguous definition of misconduct leaves room for misuse against advocates who challenge systemic injustices or oppose the BJP’s ideology.

Additionally, the bill mandates periodic verification of degrees and professional credentials every five years. While ensuring authenticity is crucial, the verification process must be transparent and fair to prevent unnecessary harassment of legal practitioners.

Call to Action
Advocates are a vital cog in the justice system and bear the immense responsibility of ensuring citizens’ access to justice. Any attempt to undermine the independence of the legal profession will not only delay justice but also erode public faith in the judiciary.

The IYC Legal Cell stands in solidarity with the Delhi Bar Association, various Bar Councils, and the entire legal community in demanding the immediate withdrawal of the contentious provisions within the Advocates (Amendment) Bill, 2025. We urge the government to engage in constructive dialogue with stakeholders to address these concerns and uphold the independence and dignity of the legal profession.

Furthermore, we call upon our state units to strongly oppose and agitate against this undemocratic bill proposed by the Central Government.
